Where as the Section 125 of CrPC is meant for support of a women who is not able to support or maintain herself, in reality the same is being grossly misused by unscrupulous women at large.

A gross misuse of the above law is evident from the case no. 208 dated 13/6/2009 at Moradabad courts filed by Ria Gupta (alias Richa Agarwal having employee Id of 72056 at Infosys Technologies Limited) against her husband Vipul Gupta. The lady although working in Infosys, Bangalore has deliberately  hidden this fact in  the court case and has mentioned that she is not working and living permanently with her parents in Moradabad Uttar Pradesh just to get maintenance from the courts from her husband.  The innocent husband is unnecessary burdened to face the trial of such false case.  Even the Infosys Ltd. Bangalore is abetting this crime by not providing the details of her employment in their company in response to a complaint letter by the husband to the Infosys Ltd., Bangalore. It is not understandable as to when such companies shall start thinking of their responsibilities of not promoting such false criminal acts by their employees.

It is good to note that various welfare groups in India take up the cause of downtrodden women. But a story in The Telegraph recently about a 71-year-old man in Kolkata who has committed suicide after his daughter-in-law threatened to file false complaints against him and his son under Sec 498A IPC (dowry law) makes me think that men need protection from women. This law, and several others like the Domestic Violence Act, are being misused by unscrupulous and crooked women to harass their husbands and in-laws. Yet, Indian society seems to think that all women are 'sati-savitris' who are incapable of lying and harassing their in-laws.

The filing of false cases against husbands/men by women are on the increase day by day. This is the direct outcome of gender biased laws framed in India such as the dowry law and the domestic violence act. Such laws have been crudely formed and is totally biased towards woman. What is appalling about these laws is that there is absolutely no redressal mechanism for the man even if heaven and earth knows that the man is innocent and the woman had filed such a case for devilish ulterior motives such as getting even for petty matters, extracting money, or even to have an extra marital affair.

In the last twelve years (1996 - 2008) 170,000 husbands have been claimed by rampant domestic violence against them. In a shocking revelation of suicide statistics for the year 2008 reveals that almost double the number of married men have committed suicide in comparison to married women as the report attached here corroborates. It states that in the year 2008 57,639 married men committed suicide in comparison to 30,224 married women whereas the same figures for the years 2007 57593 and 30,064, 2006 are 55,452 and 29,869 and for 2005 are 52,483 and 28,188.

While there has been a lot of hue and cry for domestic violence against women with various studies being sponsored for studying the same with tax payers’ money 82% of which comes from men, but sadly enough no study has ever been done in India for studying the prevalence, effects and trends of domestic violence against men or the statistics about it.

Non-Resident Indians (NRIs) are increasingly concerned about their vulnerability to the Indian anti-dowry law, namely, the IPC-498A, that was passed by the Indian Parliament in 1983. And they have reason to worry.

Under the Indian law, when a wife files dowry charges against her husband and/or his family, irrespective of the validity of the charges, the husband and/or his family members can be arrested within 24 hours without an investigation, leading to much embarrassment and physical and emotional damage caused to the accused. Since most Indian expat families looking for brides for their sons are unable to carry out detailed investigations about the prospective bride because of the lack of such a facility in the Kingdom, their vulnerability increases many folds.

Before getting into the real topic of the article, I would like to take liberty to ask readers to have a look at this short TED video, “Dan Dennett: Cute, Sexy, Sweet, Funny” which talks about why babies are cute, babes are sexy, chocolate is sweet and jokes are funny. Contrary to popular perception, it’s not that because chocolate is sweet, we like it or because babes are sexy, guys get attracted to them or that because babies are cute, we find them adorable or because jokes are funny, we laugh at them.

Family, the social unit, is the backbone of any country’s progress. The more stronger and stable is the family system of a country, better is the country’s progress. The most unique thing about family is the trust factor. However, in recent times, since the last decade or so, the family system of India is on a downhill. One of the major reasons of that, contrary to popular perception, is not due to modernization or western influence, but it is due to over-indulgence and interference of the Government as we will see it in the article.

Before talking about the interference of the Government, I would like to mention here about the principle of Laissez-Faire. The principle of Laissez-Faire tells that –

“The theory or system of government that upholds the autonomous character of the economic     order, believing that government should intervene as little as possible in the direction of economic affairs.”

Even though there was sati (suttee), with widows voluntary taking to and immolating themselves on their late husband’s funeral pyre, as devout Hindus believe, or forced to do so, as opponents of sati believe, it was purely a religious custom, that had nothing to do with women rights1. Man was the head of the family, but at home in fact he was his wife’s puppet, a situation described by the wry aside: “He is the BOSS of the House – he has his wife’s permission to say so!”
